AMAGP - SUMMARY OF POLICIES

AMAGP leadership recently adopted three policy documents, respectively on ethics, resolution of disputes, and conflict and termination of membership.

Below are summaries of these policy documents, for your information. The full documents are available on request or via the links provided in this summary.

All AMAGP members are requested to read the summaries below.

Code of Ethics (Summary)


Purpose
• Sets ethical standards for all members of the Association for Monitoring and Advocacy of Government Pensions (AMAGP).
• Guides all AMAGP activities, decisions, relationships, and engagements.

Legal Framework
• Members must comply with relevant laws and regulations, including the Nonprofit Organisations Act and AMAGP’s constitution.
• All members share responsibility for legal compliance.

Ethical Standards
1. Volunteer Appreciation: Value and encourage volunteers’ contributions.
2. Respect for Diversity: Embrace differences in values, culture, and opinions among members.
3. Honesty & Integrity: Act truthfully and respectfully in all AMAGP matters.
4. Fair Treatment: Treat everyone with dignity and fairness, especially in conflicts.
5. Confidentiality: Protect sensitive information shared within AMAGP.
6. Accountability: Members must answer for their actions and decisions.
7. Loyalty: Actions harming AMAGP’s reputation are not tolerated.
8. Transparency: Communications and records (except confidential ones) should be open and accessible.
9. Conflict of Interest: Disclose and manage any personal interests that may affect decisions.
10. Media Liaison: Only designated officials may speak to the media on AMAGP’s behalf.
11. Meeting Conduct: Follow protocols, respect diverse views, and support consensus-based decisions.

Ethics Committee
• Oversees compliance and handles complaints about breaches.
• Works with policies on membership termination for ethical violations.

Review Process
• The Code is reviewed every three years or sooner if needed, with changes ratified at the Annual General Meeting.

Resolving Disputes/Conflict (Summary)


Purpose
• The policy provides guidelines for resolving disputes and conflicts among AMAGP members, including the Executive Committee, Working Groups, and registered members.

Scope
• Applies to unresolved disputes that could negatively affect relationships or the functioning of AMAGP as a Non-Profit Organisation.
• Excludes breaches of the Code of Ethics that may lead to membership termination (handled by a separate policy).
Guidelines for Resolution
• Disputes should be resolved in the best interest of AMAGP and its members.
• Members must commit to resolving issues with dignity and mutual respect.
• An independent facilitator may be nominated to mediate discussions.
• Solutions are achieved when:
o An acceptable solution is found for all parties.
o Parties allow space for disagreement and reconciliation.
• The facilitator must:
o Clarify the nature and extent of the dispute.
o Give all parties time to share their views.
o Remain unbiased and impartial.
o Ensure parties cooperate fully and in good faith.

Outcome
• The facilitator provides written feedback on the outcome to all involved parties.
• If unresolved, members may pursue alternative dispute resolution methods as provided by law.

Policy Review
• The policy is reviewed every three years, or sooner if needed, with amendments subject to approval at the Annual General Meeting.

Termination of Membership (Summary)


Purpose
• Establishes a fair process for terminating membership when a member breaches the AMAGP Code of Ethics.

Scope
• Applies only to cases where a member’s behaviour violates the Code of Ethics.

Legal Principles
• Follows South African law principles of natural justice:
o Impartiality: Decision-makers must not be biased.
o Audi alteram partem: Both sides must be heard.
• Decisions must be legal and rational, based on adequate evidence and reasoning.

Procedure
1. Complaint Submission: Complaints must be submitted in writing to the Chairperson, with specific details.
2. Validation: Complaints must not be based on hearsay or rumours.
3. Response: The accused member is given a chance to respond in writing.
4. Assessment:
o If the accused admits the breach, they may provide reasons against termination.
o If denied, evidence is reviewed and a virtual enquiry may be held for clarification.
5. Decision: The Ethics Committee makes a recommendation to the Executive Committee, which makes the final decision. Both the accused and complainant are informed.

Record Keeping
• All communications and enquiry records are archived according to policy.

Resignation
• Membership also ends if a member resigns in writing.

Policy Review
• The policy is reviewed every three years or sooner if needed, with changes ratified at the Annual General Meeting.
